Pursuant to Section 155 of the Higher Education Act of 1965, as amended, (HEA) and to satisfy the requirements of Section 128(e)(3) of the Truth in Lending Act, a lender must obtain a self-certification signed by the applicant before disbursing a private education loan. The current form lists an expiration date of 5/31/2016 and to date, an updated form has not been provided. According to the February 29, 2016 Federal Register, a new form was submitted for approval…but you know; these things take an act of congress. Literally! In the absence of guidance from Ed, schools should continue to use the existing form until a new form is provided (I’ve emailed Ed).
